If you have created a land contract, youll also need a memorandum of land contract. This is, essentially, an abbreviated legal document that references the main contract created. This simply serves as a public notice that the buyer is interested in the property without you and the buyer having to disclose and record the entire land contract. Because the deed of the property will not be filed until youve received full payment on the purchase price indicated in the contract, this memorandum will be filed with the county and the city to serve as a record that the buyer is interested in the property.
Other options to consider are selling your land with owner financing which makes it easier for people to afford. Trying to find cash buyers can be difficult depending on your asking price and banks don't typically want to lend on vacant land. Also, if you have land you want to sell in a hurry and you'd like to get cash for it there are a number of wholesale land buyers that make be interested in making you a cash offer for your land.
This question is out of my realm...but I'm curious why you decided that the current developer is not interested in your property? If his equipment is close... it might not be that hard to deal with your property. Since you already have a house on it, I can assume there's sewage, water, electricity, etc... So your land doesn't need to really be developed, but they could build something nice on it.
Keep in mind, using the Wetlands Mapper and/or the Web Soil Survey is NOT the same thing as hiring a wetlands consultant and/or having the USACE do a delineation on your property (so realize, there are no guarantees with this approach). Your potential buyer needs to see more than just the words you use to describe the land. They also need to visually connect with the property via high quality maps and pictures of the parcel and surrounding area. You don't need to have 50 pictures but you do need at least five or so to give the buyer an idea of the terrain, soil and views as well as the road of where they would access the land. You should include a plat map (call the county for a copy), general area map (I like to use Google Earth for maps) and a topographic map is always helpful as well. You can always contact a local surveyor if you need help preparing the maps and getting the GPS coordinates.
I just ran across this post from over a year ago. Great general info! There are also local websites, specific to certain cities or regions that will advertise your property for free. In my current area of Utah, the best site is KSL.com, associated with a local newspaper. When I advertised in Southern California, Craigslist was the best free site. In some areas, nothing beats a small flyer on a physical bulletin board at the local convenient store. The best advice in this article is the CONTENT and the PHOTOS. Nobody will find your property without the right search terms, including proximity to local landmarks and features by name! - Don't just say "near lake." Put "easy walk to Fish Lake." Once a potential buyer finds your ad, the photos can reel them in. A photo of dirt and a few trees is nice but perhaps you can include a pic of you in a hammock between 2 trees or by a campfire or fishing in the nearby stream. Buying land is often much more about emotion than a list of cost vs. benefits. If it is a rural building lot, show photos of nice, nearby cabins or homes that help a buyer visualize the potential. Also remember to list other components that might make your deal stand out like owner financing or lease with option to purchase.
Land Requires Different Sales Techniques – A home has a kitchen, bathrooms and a façade that can be visual and photogenic. You can hold an Open House for a home and walk a buyer through each room to help make the sale. Buyers can easily visualize themselves in – and fall in love with – the built home. It’s just not the same for vacant residential lots and land.
