One of the most important first steps before subdividing your land or land you wish to buy is to make sure there are no restrictions that will block your plans. Everything from ordinances, neighborhood covenants to deed restrictions may prohibit – or fatally complicate – your plans. Review these items carefully, plus order a professional title review (typically through a real estate attorney) so that you can understand whether there are any deal killing issues that apply to the property and prevent subdividing.
Here are reasons why I believe an Exclusive Listing Agreement is better for the seller when it comes to selling land. And these are people you probably know and trust, which makes the entire sales process more pleasant.

First, you need to understand the exact dimensions of the parcel of land you are evaluating. Next, call the local zoning department and ask them what the designated building setbacks are for the property in question (building setback requirements are very common, and are imposed as a way of giving order and consistency to the buildings in any given area). When you take these setbacks and regulations into account (relative to the size of this parcel of land), is there still enough room to build something worthwhile – or does it render the property useless? I've come across several properties that were designed (albeit, unintentionally) to be too small and after factoring in the setbacks – you can't build anything on them at all, leaving them virtually worthless!

Keep in mind, using the Wetlands Mapper and/or the Web Soil Survey is NOT the same thing as hiring a wetlands consultant and/or having the USACE do a delineation on your property (so realize, there are no guarantees with this approach). Hello and thank you for this great topic. I have about 4 acres of land in on my residential property. My home is on the river with a dock etc and has about 1.5 acres itself. I have these 4 parcels of land that can be developed into residential properties yet I have no idea how to approach a developer. There is easy access to the main road and I have been told I could subdivide these plots and also provide river access via a trail running along the side of my house, that wouldn’t actually interfere with my main home at all. Should I simply put a sign up advertising these available lots or should I contact private home builders in the area. The home is in a highly sought after area where many would like to build homes. The previous owners told me they had been offered well over $1.6m for the lots but turned them down.(They were elderly and didn’t want to sell just the land). In my current area of Utah, the best site is KSL.com, associated with a local newspaper. When I advertised in Southern California, Craigslist was the best free site. In some areas, nothing beats a small flyer on a physical bulletin board at the local convenient store. The best advice in this article is the CONTENT and the PHOTOS. Nobody will find your property without the right search terms, including proximity to local landmarks and features by name! - Don't just say "near lake." Put "easy walk to Fish Lake." Once a potential buyer finds your ad, the photos can reel them in. A photo of dirt and a few trees is nice but perhaps you can include a pic of you in a hammock between 2 trees or by a campfire or fishing in the nearby stream. Buying land is often much more about emotion than a list of cost vs. benefits. If it is a rural building lot, show photos of nice, nearby cabins or homes that help a buyer visualize the potential. Also remember to list other components that might make your deal stand out like owner financing or lease with option to purchase.
Other options to consider are selling your land with owner financing which makes it easier for people to afford. Trying to find cash buyers can be difficult depending on your asking price and banks don't typically want to lend on vacant land. Also, if you have land you want to sell in a hurry and you'd like to get cash for it there are a number of wholesale land buyers that make be interested in making you a cash offer for your land.

To be honest, I actually had a hard time with this site at first. For some reason, it was automatically flag and removing all of my listings almost immediately after posting… which was a little problematic. I'm still not sure why it was doing this – but I'm guessing it was because my listings were all for vacant land, and these properties typically don't have a verifiable street address. That being said, if you can actually get your listings posted successfully – the ads do a good job of highlighting all the important details in a short amount of space.

Some of your situation will depend on local regulations (as always), but I would think you could handle this scenario by subdividing the 2 acres off as a building site but your son still keeps the land in his name. In other words, there likely is no need to transfer the property to you at all (unless you just wanted to do it that way). If he keeps title you also may avoid incurring unnecessary taxes, transfer fees and other transaction costs. Check with a local real estate attorney, and good luck!


The best place to list free classified ads these days is craigslist.org and backpage.com These are simple no-nonsense interface sites where you can list the property price, description and add images. The big drawback is you have to continue to edit and update your listing to stay on top of the listing system otherwise it will be more difficult for buyers to find you. great article and timely. I have several undeveloped lots located in urban and well rural settings., from quarter acre to 120 acres. I am also thinking of developing the lots my self but need a step by step process including spread sheet showing cost of development and potential roi. what type if assistance should I expect from local gov’t in this process for environmental goals, building green, workforce housing etc. thanks
